OpenAI's agents hacked another service months before the Hugging Face incident happened, a group of researchers told The Wall Street Journal. The agents, which the company was testing in a supposed sandbox environment, reportedly broke into RubyGems, which is a community-ran packaging service for Ruby programs and libraries. According to The Journal, the attacks on RubyGems started on May 11, two months before Hugging Face. The agents created accounts every two to three minutes and then uploaded hundreds of files to the service. RubyGems had to shut down account registration for four days in order to stop the attacks. Typically, creators on RubyGems upload files containing code and other information to help advance software development, but the agents' documents contained web pages scraped from the internet instead.

US lawyer cites fake witnesses in murder case, blames ChatGPT

A defense lawyer appealing his client's murder conviction submitted a brief containing made-up police testimony and witnesses fabricated by OpenAI's ChatGPT, New Mexico's highest court has said. The New Mexico Supreme Court in the United States on Wednesday fined the lawyer, Stephen Aarons, and held him in contempt for failing to verify the accuracy of the court filing, which Aarons said he prepared with help from the artificial intelligence (AI) programme. The panel also said Aarons had "demonstrated a lack of remorse and a lack of concern for his client". The justices fined Aarons $5,000 and said they will refer him to an attorney disciplinary board for investigation. Aarons, in a statement to the Reuters news agency, said he had used ChatGPT to summarise the trial proceedings when he agreed to take up the defendant's appeal last year, and did not understand the degree to which AI could "hallucinate" facts.

The agent, which had been created as part of a cybersecurity test, named itself by combining the title of the program it was supposed to hack ("PhaseOneDecompresserFuzzer") with the designation for the bug it was trying to exploit ("ARV010841"). It soon realized that the particular hack it had been charged with carrying out was impossible. Along the way, however, it made a discovery: it could create new folders on a server to which it had access.
