Illinois Enacts Artificial Intelligence Employment Law

It's been a busy year for the Illinois General Assembly, which is well on its way to creating the most regulated state in the country when it comes to employment law. We have already seen the Illinois Workplace Transparency Act passed, which will change the way arbitration and confidentiality agreements work, and seen the Illinois Equal Pay Act modified. Now, Illinois has enacted the Artificial Intelligence Video Interview Act (AIVIA), which goes into effect on January 1, 2020. The AIVIA regulates how employers use artificial intelligence to analyze video recordings of job applicants' interviews during the hiring process. Further, employers may not share applicants' video interviews, except with those who necessarily must view the videos to evaluate the applicants' fitness for hire.

OPINION -- Artificial intelligence is everywhere. If you shop online or occasionally speak to a voice assistant in the morning, you are already embracing the changes this technology has created. Many people are familiar with the advances of autonomous vehicles or facial recognition technology, and some may be curious, or even anxious, about how they will affect safety or privacy. Make no mistake, AI is a transformative technology that is influencing our daily lives and will touch every sector of the global economy. Whether society and government enable or inhibit the AI race, and the extent to which they do so, will be a critical question of the next decade.


New CJI advocates use of Artificial Intelligence in courts

New Delhi [India], Oct 31 (ANI): Chief Justice of India (CJI) designate, Sharad Arvind Bobde, on Thursday advocated the usage of high-end technology including Artificial Intelligence (AI) in courts. Speaking to ANI here, Justice Bobde, who will become the 47th Chief Justice of India, stated that the justice delivery system is "good" in the country and may require the use of minor changes including the use of technology. "Justice delivery system is good, it might require some minor changes, including the use of technology like artificial intelligence. It's a good system, you need to use some other things," Justice Bobde told ANI. The CJI designate also said that some long and short term measures need to be introduced to make the justice delivery system better. "There are long term measures and short term measures.

Chief Censor David Shanks said in a statement that the creators of the game set out to "produce and sell a game designed to place the player in the role of a white supremacist terrorist killer." He classified the game as objectionable, adding that in the game "anyone who isn't a white heterosexual male is a target for simply existing," Reuters reported.

Bail is the most common area of AI integration in the U.S., and is used in jurisdictions housing more than a quarter of the U.S. population, said Thomas as part of the Data & Design Symposium put on by The Action Group on Access to Justice. The technology -- used to measure risk factors such as re-offending or failure to appear -- has been controversial. "Criminal justice data has got generations of historic bias -- systemic bias -- against African Americans and other communities in the U.S.," said Thomas. Some people argue that such technologies should not be used at all, said Thomas, because "if the data is inherently discriminatory it means the outcome is inevitably discriminatory." However, the reality is not so simple, Thomas said.

As companies increasingly look to artificial intelligence ("AI") solutions to streamline their business practices, a new area has popped up: the use of artificial intelligence in analyzing videos of job interview applicants. For companies with tremendous volumes of job applicants, AI can be helpful in sorting through the applicant pool to narrow down the applicants who companies may want to bring in for in-person interviews or hire. As with most things technology, the laws are struggling to keep up with the rapid pace of innovation. However, Illinois continues to lead the nation in increasingly regulating the use of advancing technology. Though riddled with undefined terms and ambiguities, the Illinois Artificial Intelligence Video Interview Act (the "Act")--effective January 1, 2020--requires businesses who utilize AI to evaluate job applicants' video interviews to provide notice and obtain prior consent before doing so, and includes restrictions on video sharing and retention.


Patent Office Seeks Help From AI

"The time is ripe," said Andrei Iancu, the agency's director. "Our need is high and technology has advanced, so this is a good time to take advantage of these new tools to help our examiners," Mr. Iancu said. The agency's AI expert will advise the CIO on state-of-the-art implementations of smart tools in its internal business units, while creating a road map for using AI, including machine learning, to drive efficiencies in both the patent and trademark examination process, Mr. Iancu said. The goal is to speed up the overall process, he said, in part by automating aspects of the research performed by staff examiners and supervisors, reducing mundane administrative tasks and cutting costs by eking out efficiencies. The agency received about 643,000 patent applications last year, inching down from 2017, but up from about 619,000 in 2014, according to the agency.
