Four years of GDPR: New tech testing data privacy law's longevity?

Data protection authorities (DPAs) broadly believe the regulation's underlying principles of lawfulness, fairness, and transparency make it "future-proof" to cover developments in artificial intelligence (AI), machine learning, cloud computing, and data in a way its predecessor, the 1995 EU Data Protection Directive, failed to do. Many legal experts also believe the GDPR is flexible enough to cope with emerging technologies. Will Richmond-Coggan, director and a specialist in data protection and new technology at law firm Freeths, said, "Although it is often presented as a conflict, the reality is there is very little which technology might make possible that the (U.K. or EU) GDPR would outright prohibit." James Castro-Edwards, privacy and cyber counsel at law firm Arnold & Porter, said, "While the GDPR may not have been drafted with these new technologies specifically in mind, the broad principles of lawfulness, fairness, and transparency still apply, along with a number of additional requirements for higher risk processing." "When data protection rules are difficult to apply in practice, organizations can fall into the trap of believing that avoiding them is a pragmatic approach."


An AI Company Scraped Billions of Photos For Facial Recognition. Regulators Can't Stop It

More and more privacy watchdogs around the world are standing up to Clearview AI, a U.S. company that has collected billions of photos from the internet without people's permission. The company, which uses those photos for its facial recognition software, was fined £7.5 million ($9.4 million) by a U.K. regulator on May 26. The U.K. Information Commissioner's Office (ICO) said the firm, Clearview AI, had broken data protection law. The company denies breaking the law. But the case reveals how nations have struggled to regulate artificial intelligence across borders. Facial recognition tools require huge quantities of data.


DHS is going bigger with its next face biometrics rally

The U.S. Department of Homeland Security opened industry applications for its 2022 Biometric Technology Rally. The department's Science and Technology directorate is emphasizing discerning people in groups and their level of consent to face biometric scanning. Competitors are to address the challenge of reliably screening small groups of people opting in to facial recognition from among bystanders who have not consented. The competition will be an unattended "high throughput" scenario where group-processing systems must rapidly capture biometrics from multiple subjects. Companies will have to match photographs and identify faces, acquire only needed biometric images and meet performance benchmarks for demographic groups.

Wise Health System Partners with Biofourmis for Continuum-Wide Care-at-Home Initiative

Biofourmis, a Boston-based global leader in virtual care and digital medicine, has announced its engagement with Wise Health System to launch a continuum-wide care-at-home initiative. Wise Health System is a four-hospital, integrated care network in the Dallas-Fort Worth metropolitan area. Wise Health System will launch the effort with a home hospital program leveraging Biofourmis' Hospital@Home end-to-end solution that combines artificial intelligence (AI)-based remote patient monitoring technology and clinical support services. Wise Health System has nearly 200 beds across its four-hospital campus, with over 200 physicians and more than 2,000 employees. The health system is launching a hospital at home program with Biofourmis as part of its progressive healthcare delivery philosophy, to enable participation in the Centers for Medicare and Medicaid Services' (CMS') Acute Hospital Care at Home program, for which it has already earned a waiver.

On a beautiful day in May 2015, I drove the 13 hours from my home in Portland, Oregon, to Harris Ranch, California, halfway between San Francisco and Los Angeles. At the time, Tesla was touting a battery-swap station that could send Tesla drivers on their way in a fully powered vehicle in less than the time it takes to fill up a car with gas. Overtaken by curiosity, I had decided to spend a long Memorial Day weekend in California's Central Valley to see if Elon Musk's latest bit of dream weaving could stand up to reality. There, amid the pervasive stench of cow droppings from a nearby feedlot, I discovered that Tesla's battery swap station was not in fact being made available to owners who regularly drove between California's two largest cities.
