Are Fantasy Sports Really Gambling? - Issue 44: Luck

Nautilus

Early one Saturday morning in Las Vegas, I sat down at a Texas Hold'em poker table with seven or eight other men, all middle-aged. Being 30 at the time, I was the youngest player by about a decade. A couple of them were wearing Hawaiian shirts. It was too early for drinking, but one or two guys puffed on cigarettes as the cards were dealt. The buy-in was $75, far more than I'd ever paid for a poker game. I played in a regular poker game in New York City, and I was feeling good about my abilities. I decided to use a conservative strategy to extend my time on the table: Only stay in a hand when I have cards worth playing.

Starting today, DraftKings' Leagues will offer that functionality for its customers. Leagues function as private groups in which users can invite friends for weekly NFL games instead of the daily fantasy commitment. For example, if you wanted to set up a contest for a specific week of the season, you could do so without having to play through all of the NFL slate. And if pro football isn't really your thing, DraftKings Leagues are open to other sports as well (10 total), including MMA and League of Legends, and you can have contests in different sports among members of the same group. Where DraftKings begins to venture further into the realm of season-long fantasy is its new leaderboards.

For the most part, the practice of fantasy sports law entailed interpreting how state common laws would interpret the legality of particular fantasy sports games. This involved seeking to ensure that clients' fantasy sports contests involved the requisite level of skill to chance to comply with state common law. Today, however, the practice of fantasy sports law has changed dramatically.
